Commissioners Mull Background Checks The
Ward County Commission is considering requiring background
checks on some potential new workers. Commissioners have
sent the issue to the county Human Services Department to
develop a policy. Commissioner Jim Lee proposed requiring
financial checks on anyone who handles money for the county.

Driver's Ed Background Checks Lacking
The
Wisconsin Department of Transportation does not conduct
national criminal background checks of the estimated 700
commercial driving school instructors it licenses annually,
checks that DOT officials say they now may pursue.
The
DOT learned about William Webb's out-of-state 1992 child
molestation conviction after Webb committed a new crime
in Wisconsin - possession of child pornography - in his
Milwaukee home. Company owner Melissa Dolney called Webb,
who could not be reached for comment Wednesday, a "very
good employee." Dohney said she would have never hired
a sex offender, and that she plans to beef up background
checks.

Background Checks on Campus
In the summer of 2003 Baylor University was rocked by the news
that one its basketball players, Patrick Dennehy, had been murdered.
A former teammate of his, Carlton Dotson, was charged with the
crime and pleaded guilty. In
the wake of this tragedy the Univerity has started conducting
background checks on athletes who transfer to the school. At the
time this article was written it was reported that only one other
school, University of Oklahoma was performing similar checks.

Employee Background Checks
16,400
threats are made, 723 workers are attacked and 43,800
employees are harassed in the workplace in the United
States each day (Alexander Hamilton Institute, Employment
Law Resource Center). Employees who have past criminal
actions or workplace misconduct carry out a shocking
number of these incidents. The monetary repercussions,
i.e., workplace theft, espionage, frivolous lawsuits,
etc., of incidents stemming from poor hiring decisions
can be devastating, costing U.S. businesses an estimated
$18 billion per year. Employers can be held liable
for negligent hiring if they know, or should have
known, that an employee is a potential risk to others.

Junk Faxes |

Whether
you work in a big business or are
self- employed, you probably get your fill of
junk faxes promising low mortgage rates or vacation
deals. Besides tying up your fax machine, they
waste your paper and ink. So Congress recently
passed the Junk Fax Prevention Act, which will
require each unsolicited faxed ad to have a highly
visible opt-out notice. (The FCC actually had
proposed tougher rules: requiring recipients to
say "yes" before being faxed.) The terms
of the new law should make it easier to get off
solicitation lists—although, like the telemarketing-prevention
program, it may allow nonprofit organizations
to continue contacting you. |

FBI
Lists Top Corporate Sources Of ID Theft
Your organization
can make some inroads into stopping identity theft by keeping
a close eye on three corporate hotbeds identified by the FBI.
A study of cases of ID theft shows many begin with crooked individuals
who snag information. Those individuals often burrow into companies
via:·
- temp services
that hire without adequate background checks
- janitorial
or similar contract services, and
- call centers
where some employees have access to confidential customer or
employee information.
That's not
to say that temps, janitors and call-center workers are shady
– just that those are the more likely sources of ID theft.

Criminal Background Checks for Volunteers
Congress
and the public at large are convinced that criminal
record checks are a good method to screen teachers,
caregivers, program staff and others who have contact
with children and vulnerable populations. The data
on crimes against children, compiled by the U.S. Department

Advocates Call for Federal Action to Curb Workplace Abuses Caused
by Criminal Background Checks
Today, national
groups representing labor, civil rights and privacy advocates,
called attention to the significant expansion of legal mandates
that prohibit employment of people with criminal records. They
urged the U.S. Attorney General and Congress to limit abuses that
undermine and has strict privacy regulations. Hong Kong has a
fairly strict information-protection act, and European countries
adhere to Safe Harbor regulations, which prohibit the transfer
of personal data to non-European Union nations that don't meet
the European standard for privacy protection.

Sex Offenders - Legislators Propose Stricter Laws
Legislators
Peter O’Leary (R-Shirley) and Allan Binder (R-Huntington)
recently put forth three initiatives that will strengthen
Megan’s Law, expand the measures taken to monitor
sex offenders and place stricter guidelines for hiring
in the fields of youth services and hotlines for children
who are victims of sexual abuse. Speaking of making
it mandatory to check for employees’ registration
on the New York State Sex Offender Registry, O’Leary
commented, “You would think that employers would
want to do it voluntarily. The most important part
of their jobs is the protection and safeguarding of
children.”Laura Ahearn, executive director of
Parents for Megan’s Law, explained that without
checking for employee registration with the New York
State Sex Offender Registry, organizations are setting
themselves up for inviting convicted sex offenders
to attain jobs with them.

Lying
on Job Application Nets 40 Arrests
When New Jersey's Security Guard Act of 2005 goes into
effect in September, certain ex-convicts who are working
as security guards in the state will be arrested on
a disorderly persons charge. Previously, these ex-convicts
merely would have been fired if their criminal backgrounds
had been discovered. The act has two aims: to deter
ex-convicts from applying for jobs as security guards,
and to jolt the private sector into taking appropriate
actions to determine if their security guards have been
screened properly, says New Jersey Attorney General
Peter Harvey. Applicants for security guard positions
are required to sign a notarized affidavit that they
have clean criminal backgrounds. To call attention to
the act, state authorities launched "Operation
Sentry," arresting 40 ex-convicts between May 23
and June 9 for allegedly lying about their criminal
backgrounds when applying for jobs as security guards.

Bureaus Branching Out
The credit-reporting
industry is leaving the shadows and moving into more direct dealings
with consumers. This $3 billion-a-year industry can influence
(people’s ability to get a loan, land a job and buy insurance.)
"Credit reports are now being used as indicators of character
and of fitness for jobs, for insurance and for other non financial
dealings," Warren said. "No one's sure whether any of
those inferences are right. Many employers simply won't hire people
who have bad credit records."

Firms Decry Faulty Background Checks
Employers
are failing to get sufficient information from background checks
into prospective employees' pasts, new research warns. A study
by IRS Employment Review shows a third of employers feel the information
they receive from the Criminal Records Bureau (CRB) is not always
accurate. A further quarter complain that the administration and
level of service they receive is unsatisfactory. Fewer than one
in 10 say they receive their standard disclosure information within
two weeks, while a fifth have waited up to six weeks.

Australia's Port Authorities Fear Security Breaches
Security
at Australia's ports is being put at risk by irregular criminal
background checks of workers and a lack of proper controls
on foreign ship crews, port authorities say. The concerns
have been expressed in a submission to a Senate inquiry
into changes to maritime transport security laws, which
is due to report on August 9. The Association of Australian
Ports and Marine Authorities said it was worried that background
checks for workers, to gain a maritime security identification
card (MSIC), were only renewed every five years. Click

passengers should steer clear of less established
companies, land transport authorities say, following
another sex attack by a taxi driver

in Wellington. A 22-year-old woman told police she was
raped in the back seat of a taxi near her Johnsonville
home in daylight on Saturday morning. A Hamilton taxi
driver is being hunted after a student was raped at
the end of June. Police say they are following "good
leads" in the Wellington case. Land Transport New
Zealand spokesman Andy Knackstedt said the screening
system for those applying to carry passengers was "fairly
robust" – but there was room for improvement.
"Hindsight is 20/20, but one thing we encourage
people to do before getting into a taxi is to see what
company it is," he said today. It was generally
well known which companies were "established"
in each city and which were not, he said.

The
CV Detectives
It might
seem like the only way to secure that dream job, but with
one in four people lying on their CVs, employers are wising
up, and have identified the typical fibs people tell. A
quarter of 3,000 CVs submitted with job applications in
2004 had a lie in them, says employee screening firm Risk
Advisory Group. And while the section headed "personal
interests and achievements" may seem like a legitimate
area for exaggeration, some of the lies are far more serious
than fibs about undergraduate life.

Life For Sale" a couple of weeks ago, the most
shocking detail likely was a photo of a reporter and

alleged Indian fence purporting to depict the exchange
of $5,000 for stolen credit-card data. This was yet
another blow to the offshoring community. It follows
closely on the heels of perhaps the most infamous
identity-theft case in India, one that resulted in
nearly $500,000 in bank losses and a whopping 17 arrests.
While the world waits to see how the Indian police
and courts handle these landmark investigations, both
outsourcing customers and providers are examining
what changes, if any, should be made to hiring practices
in global delivery centers.
