The correct answer is #4 – January 12, 2012. Employers must ensure that sections 1 and 2 of the Form I-9 are completed within three business days of the employee’s first day of work for pay (January 9th in our example). So if the employee started work for pay on Monday, the employer must complete Section 2 by Thursday of that week (January 12th). Note that if the job lasts less than three days, the employer must complete Section 2 no later than the first day of work for pay.
