In New York, employers requesting consumer reports must provide a copy of Article 23-A of the New York Correction Law to an applicant or employee when:

a) At the time the disclosure/authorization for is presented for signature to the consumer regardless of the type of consumer report requested.

b) At the time the disclosure/authorization for is presented for signature to the consumer only if the employer requests an investigative consumer report

c) At the time the disclosure/authorization for is presented for signature to the consumer only if the employer requests an investigative consumer report and if the consumer report contains a "hit"

d) At the time the disclosure/authorization for is presented for signature to the consumer regardless of the type of consumer report requested and at if the employer is planning on taking adverse action.
