Industry Overview
KPMG
reports (May 2005) that the background screening industry
is highly fragmented, with thousands of providers –
creating a barbell shape. According to KPMG, The pre employment
screening industry represents a $2 billion domestic market.
The five largest participants are positioned on one-end
(US Investigations, First Advantage, ChoicePoint, Kroll
and ADP), a large number of smaller players are on the other,
with a relatively few number of companies in between. Only
four companies have screening revenues exceeding $100 million
annually, two exceeding $400 million. Less than 10 have
revenues of over $40 million, less than 15 at $20 million
and less than 25 are at over $10 million.Investment banking
firm Robert W. Baird & Co. estimates annual growth for
the pre employment screening industry at approximately 7%,
on the assumption that overall market penetration grows
from 50% to 70%.

Banks
Face Challenge In Screening Employees To Avert Inside ID Thefts
When two of
the nation's largest banks were forced to notify thousands of
customers that their financial records may have been stolen, there
wasn't a hacker, a missing laptop or a lost box of backup computer
tapes to blame. This time, police believe, customers of Wachovia
Corp. and Bank of America Corp. were the victims of bank employees,
workers whose jobs at the Charlotte-based banks granted them access
to information valuable enough to sell for $10 an account. Click

Programs (OFCCP) has issued a final rule clarifying record

Five Surprises in the New Junk Fax Law

new junk fax law changes how you can fax information to
customers. Here's five gotchas you weren't expecting. If

surprise--the feds now have a new law governing junk faxes

Act of 2005 (JFPA), which went into effect on July 9, 2005,

Employment Based Immigration Visa `Bank’ Created
The $82 billion
"Emergency Supplemental Appropriations Act for Defense, the
Global War on Terror and Tsunami Relief of 2005" contains
immigration measures affecting the admission and employment of
foreign nationals in the United States. It also recaptures unused
employment? based immigrant visas for workers in specified Schedule
A occupations, notably registered nurses and physical therapists.
The act places the employment based visas for Schedule A occupations
that went unused from fiscal years 2001 to 2004 in a "bank"
for future use, when demand for employment-based visas in EB-1,
2 and 3 categories exceed the annual quota. The legislation also
sets minimum standards for federal recognition of state-issued
identification cards and driver's licenses, including verification
of immigration status; ostensibly to make obtaining these documents
nearly impossible for undocumented workers. The provisions become
effective in May 2008.
Contractors
Hit by Fallout of Predator Act
An amendment
to the Jessica Lunsford Act passed in Florida earlier this year
is hitting some contractors hard in their wallets. In an attempt
to restrict sexual predators' access to children, the law requires
contractors to have a full background check completed before they
can work on school property. Steve Cona Jr., president and CEO
of the Associated Builders and Contractors' Florida Gulf Coast
chapter, opposes the legislation due to the costs and time involved
in conducting background checks on as many as 250 workers per
job site. Cona has proposed a revision that would force contractors
to submit sworn written certification each year that all workers
have been screened, charging violators with a first-degree misdemeanor.
Manatee County School District attorney John Bowen thinks it would
be easier to charge sexual predators who set foot on school property
with a third-degree felony offense, as such a charge is likely
to keep them off campus.

Michigan
Background Screening
Michigan lawmakers
are considering a bill (S.B. 621) that would require all of the
state's 5,000 nursing homes to conduct criminal background checks
on all prospective employees. Also, the bill would require these
facilities to conduct annual criminal back-ground checks on current
workers. Failure to enforce these rules would be a felony punishable
by a fine of $ 50,000 and up to four years in prison. The bill
has a good chance of becoming law because it was authored by Michigan
Attorney General Mike Cox and was introduced after a state-sponsored
study revealed that 25 per-cent of those residential-care employees
who committed crimes against patients had prior convictions for
similar acts.'

Recommends Japan Conduct Back ground Checks on Nuclear Facilities’
Employees
Japan, which
has relied on the belief that employees are inherently good, had
to adopt a background check system after the International Atomic
Energy Agency demanded in the 1999 Physical Protection of Nuclear
Material and Nuclear Facilities Rev. 4 that member countries determine
the trustworthiness of their employees. The Economy, Trade and
Industry Ministry's subcommittee on nuclear disaster prevention,
which supervises commercial nuclear power plants, compiled in
June a report on measures to cope with internal adversaries at
nuclear facilities. The report says the government should establish
a system for cross-sectional background checks on officials responsible
for defense and law and order. Click

Global
Screening Increasing
As India and
the Far East economically expand so, too, does the demand for
background screening. But it ain't easy, say experts in the field.
Consider: There are 27 different ways to spell the name Muhammad.
Each person born in India has two dates of birth—one biological
and one when the birth is officially recorded. In China, the history
of government monitoring of personal lives makes residents wary
of company background checks. Nevertheless, demand is high, says
Traci Canning, director of international operations for HireRight,
a screening company based in Irvine, Calif. Many American companies
adopt global policies that call for pre-employment screening,
she says, and as multinationals set up offshoring companies—or
contract with native companies—around the world, those policies
are enforced. The scale of growth in India and Asia offers special
challenges. In China, for example, the country is projected to
grow about 20 million new jobs this year. In India, it's about
12 million jobs, says Valez. Contrast that growth with the 1.5
million U.S. jobs projected this year, he says. Click

Fraud
boomed in the United Kingdom in 2004
A survey by
accounting firm BDO Story Hayward indicates that the value of
reported fraud doubled from 2003. The most significant increases
were in utilities, information, manufacturing and wholesale trade.
By contrast, fraud actually declined in retail, educational services
and transportation and warehousing.
